By creating an account or using our Services, you agree to be bound by these Terms. Account Registration: You must provide accurate and complete information when creating an account, and you are responsible for maintaining the security of your account credentials. You are solely responsible for all activities conducted under your account. Service Usage: You may use our Services only for lawful purposes and in accordance with these Terms. You agree not to use our Services to generate content that infringes on third-party intellectual property rights, violates applicable laws or regulations, is harmful, defamatory, obscene, or otherwise objectionable, or attempts to circumvent our content moderation or security controls. Intellectual Property: You retain full ownership of all content you upload to our platform. Subject to your compliance with these Terms, we grant you a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, distribute, and publicly display all content generated using our Services for commercial and non-commercial purposes. We retain ownership of our platform, technology, AI models, and all related intellectual property rights. OUR TOTAL AGGREGATE LIABILITY UNDER THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO CROYTA IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM. Indemnification: You agree to indemnify, defend, and hold harmless Croyta LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of your use of the Services, your violation of these Terms, or your generation of content that infringes on third-party rights. Termination: We may suspend or terminate your account immediately for breach of these Terms, including non-payment of subscription fees or violation of our content policies. You may terminate your account at any time through your account settings. Upon termination, you lose access to your account and all stored content, subject to our 30-day data retention policy for deleted accounts. Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any dispute arising out of these Terms shall be resolved exclusively in the state or federal courts located in San Francisco County, California.
